Se è previsto che l’autorità di pubblica sicurezza non può concedere la licenza per l’apertura di un teatro o di un luogo di pubblico spettacolo, prima di averne fatto verificare da una commissione tecnica la solidità e la sicurezza, un motivo ci sarà. A dirlo è il T.U.L.P.S., una norma, tuttora attuale, che subordina l’effettuazione di trattenimenti e spettacoli al preventivo ottenimento della dichiarazione di agibilità dei locali/luoghi di pubblico spettacolo, cioè di quel documento che attesta le condizioni di solidità, sicurezza ed igiene di locali ed impianti che, in casi come questo, è di competenza delle Prefetture. È il messaggio tuonato, da tempo, dal Circolo della lega Salvini di Capaccio Paestum e dal suo Coordinatore avv. Giovanni Licinio. Preoccupazioni, soprattutto per la sicurezza, che hanno indotto il Circolo locale del Partito di Matteo Salvini a ricordare che presso le Prefetture sono istituite le Commissioni provinciali di vigilanza sui locali di pubblico spettacolo che, come prevede l’art. 142 del Regolamento per l’esecuzione del T.U.L.P.S., esprimono un parere sui progetti di nuovi locali di pubblico spettacolo e impianti sportivi, o di sostanziali modificazioni a quelli esistenti (c.d. parere di fattibilità) oltre a verificare le condizioni di solidità, di sicurezza e di igiene dei locali realizzati o ristrutturati (c.d. verifica dell’agibilità). In località Laura del Comune di Capaccio Paestum è stata installata recentemente una ruota panoramica, inaugurata il 23 giugno scorso per la quale non era dato comprendere se il Comune di Capaccio Paestum avesse avuto parere positivo per tale installazione – sottolinea il Coordinatore locale della Lega Salvini Premier, avv. Giovanni Licinio – considerando il fatto che la proiezione a terra della ruota sulla strada prospiciente alla stessa supera una corsia della stessa. A tal uopo, anche per la tutela della pubblica incolumità, abbiamo ritenuto di chiedere se per tale installazione vi fosse stato il rispetto del Codice della strada e del Regolamenti edilizi – continua Giovanni Licinio – per il mancato rispetto delle distanze dalle strade che insistono nel raggio di azione della ruota panoramica. Convinti del fatto che per tale installazione bisognava acquisire preventivamente l’autorizzazione della Commissione provinciale di vigilanza sui locali di pubblico spettacolo, oltre che il rispetto delle distanze dalle strade – prosegue l’esponente della Lega Salvini – abbiamo interessato del problema la Prefettura, il Comando provinciale dei Vigili del Fuoco di Salerno ed il Comando di Polizia Municipale di Capaccio Paestum, ognuno per le proprie dirette competenze.
Ad oggi ci giungono le risposte della Prefettura e del Comando provinciale dei Vigili del Fuoco di Salerno che, lasciandoci perplessi, evidenziano di non essere a conoscenza di nulla tanto da sottolineare testualmente, per i Vigili del Fuoco – conclude l’Avv. Licinio – di non aver mai espresso alcun parere di merito né di essere mai stati convocati per l’espressione di parere di competenza in seno alla Commissione Comunale di Vigilanza per il pubblico spettacolo ex articolo 80 del T.U.L.P.S. Se gli uffici prefettizi, in una missiva al Comune, scrivono “tenuto conto delle primarie esigenze di garanzia delle condizioni di sicurezza, si prega di voler far conoscere notizie in merito ai provvedimenti adottati in relazione alla tipologia di attrazione, alla capienza della stessa ed alla sua ubicazione” quale risposta darà l’Ente? Che la Ruota occupa con la perpendicolare esterna del suo raggio quasi mezza carreggiata? Che le distanze dai confini non sono state rispettate? Intanto… la ruota gira ancora. Alla faccia di tutti.
