L’autonomia e l’indipendenza della Magistratura: sono ancora dei principi insormontabili?
Ai sensi dell’art.101 Costituzione, sono espressamente enunciati due principi fondamentali: “La Magistratura costituisce un ordine autonomo ed indipendente da ogni altro potere”. Da tale norma, è possibile desumere il principio di autonomia e quello di indipendenza della Magistratura. Il primo principio sancisce che la Magistratura rappresenti un’istituzione autonoma e, come tale, non può essere oggetto di indebiti condizionamenti da parte degli altri poteri dello Stato. Il secondo principio, l’indipendenza, ha la funzione di garantire che l’organo giurisdizionale sia sempre “super partes”, perciò mai fazioso rispetto alla fattispecie che ha il compito di giudicare. Tuttavia, partendo da un caso recente, è possibile desumere quanto questi principi fondamentali e la loro inviolabilità siano piuttosto labili. Succede che un avvocato accusa un procuratore capo e altri magistrati denunciando una gestione illecita del sistema giudiziario e l’esistenza di intrecci tra alcuni magistrati, avvocati e giornalisti. Sulla vicenda indaga un’altra Procura, che rileva la non fondatezza delle dichiarazioni dell’avvocato, contestando allo stesso i reati di diffamazione e calunnia. Nel caso di specie, infatti, si evince quanto la Magistratura, ancora una volta minacciata nella qualità di ordine istituzionale, si preoccupa di fornire un valido strumento di protezione per se stessa. La diatriba, infatti, tra il procuratore e l’avvocato è stata definita da una diversa Procura a seguito di denunce fatte. Ciò a dimostrazione del fatto che la Magistratura in tutte le sue sfaccettature, anche in questa occasione, mantiene una sorta di garanzia a tutela giuridica sia per se stessa, sia della parte offesa che dell’imputato.
Si può affermare che ad oggi la Magistratura si erge sui principi di autonomia e di indipendenza?
No, ad oggi in Italia non esistono più i concetti di autonomia e di indipendenza della Magistratura. Ciò alla luce del fatto che nel nostro ordinamento giuridico è previsto un vulnus di principi che vanno dall’esercizio dell’azione penale all’indipendenza fino a giungere alla giurisdizione. Per quanto attiene all’obbligatorietà dell’azione penale, questa non costituisce una vera e propria garanzia a tutela di tutti i cittadini, in quanto un cittadino parte offesa per lo stesso procedimento penale, per uno vengono avviate le indagini preliminari mentre per l’altro no. Per quanto riguarda l’indipendenza, al pari di tutti i funzionari dello Stato, anche per i magistrati dovrebbe essere prevista una responsabilità giuridica nei loro confronti. Infine, per quanto attiene alla giurisdizione, nel momento in cui si viene a conoscenza, durante la fase delle indagini preliminari, dell’esistenza di un fatto che costituisce reato, che necessariamente deve passare alla Procura, questo non avviene mai.
Quale tipo di intervento legislativo è auspicabile?
Attualmente, in Parlamento si vuole approvare una legge che riconosca da un lato una responsabilità giuridica dei magistrati e dall’altro garantisca a tutti i cittadini di avere un processo giusto e veloce per far sì che la giustizia italiana funzioni.
