Immagina di essere in un letto, gli occhi al soffitto, di non poter muovere le braccia, di non poter muovere le gambe, di non riuscire a parlare. Immagina di non poter passeggiare, di non poter masticare, di non poter vedere null’altro se non il buio o le dita dei tuoi piedi. Immagina di non poter sentire le voci familiari o di sentirle senza poter rispondere, immagina di non avere un futuro. Immagina che non esistano i giorni, le ore, i minuti, i secondi, immagina che non esistano più i momenti. Immagina di non avere un momento per correre, un momento per studiare, un momento per cadere, uno per rialzarti, un momento per ridere, uno per piangere, immagina che non ci sia più un momento per accarezzare qualcunƏ, il momento di mangiare, il momento di dormire, di fare uno shampoo. Immagina che non sia più tempo di stringere una mano e che il tempo non esista. Immagina che né tu né nessunƏ altrƏ per te possa mettere fine a tutto questo, non legalmente. La possibilità di far sì che un tale incubo non abbia luogo è nelle mani del nostro Parlamento, il quale non legifera in materia di eutanasia, pur essendo da 40 anni un tema presente nel dibattito pubblico. Risale al 1979 una prima raccolta di firme e al 1984 una prima proposta di legge dell’allora ex ministro Loris Fortuna. A smuovere le acque sono stati negli anni i casi di persone che con la propria vita e la propria morte hanno costretto a riflettere sul fine vita: Piergiorgio Welby, Eluana Englaro, Fabiano Antoniano (dj Fabo). Quest’ultimo è morto il 27 febbraio del 2017 in Svizzera, ottenendo clandestinamente l’assistenza alla morte volontaria con l’aiuto dell’attivista Marco Cappato che al suo rientro in Italia si è autodenunciato affrontando un processo presso la Corte d’Assise di Milano. A ottobre 2018 la Corte Costituzionale ha sospeso la sua decisione rinviandola a settembre 2019 e invitando il Parlamento a legiferare, ma l’opportunità non è stata colta. Il Senatore Matteo Mantero (ex 5stelle passato a PAP) ha presentato un disegno di legge, ma a Palazzo Madama la discussione non è mai partita e Cappato è stato definitivamente assolto a dicembre 2019. Di fatto, quindi, il suicidio assistito, a determinate condizioni, non è stato considerato un reato. Si presentava in questi giorni la possibilità di un referendum (che in Italia è soltanto abrogativo) per il quale sono state raccolte 1.239.432 firme, per iniziativa dell’Associazione Luca Coscioni. L’ufficio comunicazione della Corte Costituzionale, la cui sentenza è in attesa di essere depositata, ha dichiarato che “a seguito dell’abrogazione, ancorché parziale, della norma sull’omicidio del consenziente, cui il quesito mira, non sarebbe preservata la tutela minima costituzionalmente necessaria della vita umana in generale, e con particolare riferimento alle persone deboli e vulnerabili”, considerando inammissibile il quesito referendario. È evidente che la natura abrogativa del referendum non consente la formulazione di un impianto legislativo pacificamente aderente al diritto costituzionale. Toccherebbe al Parlamento fare le leggi. Oltretutto, il testo di legge sul suicidio assistito in discussione al Senato, frutto di un accordo di maggioranza, risulta essere peggiorativo rispetto ai diritti ad oggi conquistati nei Tribunali ed in generale rispetto all’attuale assetto costituzionale. Si sta sprecando l’occasione di colmare il vuoto di tutela rispetto a quei malatƏ che oggi non rientrano nelle condizioni stabilite dalla Corte Costituzionale in materia di suicidio assistito (caso Cappato/Antoniani), come Ə malatƏ che non sono dipendenti da trattamenti di sostegno vitale o quelli che non sono materialmente in grado di autosomministrarsi il farmaco letale, legalizzando l’eutanasia. Il diritto alla vita è il primo tra i diritti inalienabili di tutti gli esseri umani, ma il secondo è senza dubbio il diritto alla propria morte, quando la vita non è più sostenibile. La possibilità di autodeterminarsi, dall’inizio alla fine della propria esistenza, deve essere garantita nel rispetto della libertà e della dignità di ognunƏ.
